"the kudlow report" starts right now. let's get the latest on the snag on the fiscal cliff talks and surprise news we are going to reach the debt ceiling in days instead of just a few months. john harwood has the details. what's going on? >> not a whole lot of actions going on. although there have been some developments. let me bring our viewers up to date on those. first of all, treasury secretary geithner this afternoon announced the united states would hit the statutory debt limit on monday. that's new year's eve. that's part of an effort to pressure congress to act to raise the debt limit which may or may not be direct limb reply indicated in the fiscal cliff talks but it is relevant to the larger issue of debt and deficits. the treasury can move money around in certain ways to extend the point where we actually reach a crisis for probably a couple of months. but this is an early warning sign. secondly, republicans in the house sent word to democrats in the senate, white house, it is your turn now. we acted to put off

here is with cnbc's larry kudlow. >> let me ask you, sir. do you think tonight there will be a senate vote on some kind of deal? >> well, i think there should be very late tonight or early in the a.m., even if this gets enacted in the next couple of days, it's all going to be retroactive to january 1st. but the very point of it is when you have a deal of this nature, you need to get it passed before you start having all the interest groups start finding out everything they think is wrong with it and giving people excuses not to support it. >> and that tax deal was reached after intense negotiations between senate minority leader mitch mcconnell and vice president joe biden. here are some of the highlights. the proposed deal is set to raise over $600 billion in revenue through new tax increases on the wealthiest americans. the bush era tax rates would be extended for all single americans with income below $400,000. and couples with income below $450,000. all income above those levels would be taxed at a clinton era top tax rate of 39.6%. and

a deal does not make law. it's just a first step. but it's a very meaningful breakthrough. >> kelly o'donnell, thank you so much. kristen welker is at the white house. she joins us live now. kristen, what is the word coming from the white house right now with the vice president on his way over to capitol hill to speak there in just a few minutes now? >> well, the white house not yet commenting on this deal that is coming to fruition. but they have confirmed that the vice president is heading over to the hill. and they have been saying all night that he is prepared to go over to the hill once negotiations reach this stage. so he is essentially going there to put the final stamp on this deal that kelly is reporting about, to sell it to the members of the caucus. as you mentioned, milissa, at the top of the broadcast, there has been some dissent among l.a. labor leaders. richard trumka tweeting that democrats should hold off on approving this deal. he says it's not good enough in part because the tax rates are on those who are making $4
